These Terms of Service ("Terms") govern your access to and use of the Trellis2.app website and services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
By creating an account, accessing, or using our Services, you confirm that:
- You are at least 13 years of age.
- You have the legal capacity to enter into these Terms.
- You agree to comply with these Terms and our Privacy Policy.
If you do not agree with these Terms, you must not use our Services.
Trellis2.app provides AI-powered image-to-3D model conversion services. Our Services include:
- AI 3D Model Generation: Converting 2D images into 3D models using AI technology.
- AI Image Generation: Creating images using AI models.
- AI Text and Chat: AI-powered text processing and conversational assistance.
- Account Management: User profiles, subscription management, and credit-based billing.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice for material changes.
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your account information updated.
- Maintain the security of your password and account credentials.
- Accept responsibility for all activities under your account.
- Notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account if:
- You violate these Terms.
- Your account has been inactive for an extended period.
- Required by law or legal process.
- We reasonably believe your account has been compromised.
We offer free and paid subscription plans. Plan details and pricing are available on our Pricing page. We reserve the right to change pricing with 30 days' advance notice.
Our Services operate on a credit-based system:
- Credits are consumed when you use AI generation features.
- Different features consume different amounts of credits.
- Credits may expire according to your plan's terms.
- Credits are non-transferable between accounts.
- Payments are processed by Stripe. We do not store your full credit card information.
- Subscription fees are billed in advance on a recurring basis (monthly or yearly).
- You authorize us to charge the applicable fees to your payment method.
- Subscriptions: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
- Credit Purchases: Credit purchases are final and non-refundable.
- Exception: If you experience a technical failure that results in credits being deducted without generating output, contact [email protected] for a credit refund.
The Trellis2.app website, its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws. This includes our logos, design, and software.
You retain all rights to content you submit to our Services (original images, text, etc.). By submitting content, you grant us a limited, worldwide, non-exclusive, royalty-free license to:
- Process your content to provide the requested Services.
- Store your content as necessary to deliver and maintain the Services.
- Display your content within your account.
- You own the output generated by our AI services (3D models, images, text) to the extent permitted by applicable law.
- You are responsible for ensuring that your input content does not infringe on third-party intellectual property rights.
- We do not claim ownership of AI-generated outputs, nor do we guarantee that outputs are free from intellectual property claims.
You agree not to:
- Use our Services in violation of any applicable law or regulation.
- Submit content that is illegal, harmful, threatening, abusive, defamatory, or obscene.
- Upload content that infringes on the intellectual property rights of others.
- Attempt to reverse-engineer, decompile, or extract our AI models or proprietary technology.
- Use automated systems (bots, scrapers) to access our Services without authorization.
- Share your account credentials with others or resell your account.
- Use our Services to generate content that impersonates others or spreads misinformation.
- Circumvent usage limits, credit systems, or security measures.
We reserve the right to review and remove any content that violates these Terms or that we deem inappropriate, without prior notice.
If our Services allow you to share or publish content publicly:
- You are solely responsible for the content you share.
- You represent that you have all rights necessary to share the content.
- We may remove content that violates these Terms or applicable laws.
- You grant other users a limited license to view your shared content within the platform.
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability, fitness for a particular purpose, and non-infringement.
- The Services will be uninterrupted, secure, or error-free.
- The results obtained from the use of the Services will be accurate or reliable.
- Any errors in the Services will be corrected.
AI-generated outputs may contain inaccuracies or artifacts. We do not guarantee:
- The quality, accuracy, or suitability of AI-generated 3D models, images, or text.
- That AI outputs will be free from defects or meet your specific requirements.
- The compatibility of outputs with any particular software or hardware.
You should review and validate all AI-generated content before using it for any purpose.
To the maximum extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
- Our total liability for any claim arising from these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.
- We are not liable for any loss or damage arising from third-party services (e.g., Stripe, AI providers).
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your use of our Services in violation of these Terms.
- Your violation of any applicable law or regulation.
- Your content that infringes on third-party rights.
- Any AI-generated content you distribute or commercialize.
These Terms remain in effect as long as you use our Services.
You may terminate your account at any time by deleting it through your account settings or by contacting us.
We may terminate or suspend your access to our Services immediately, without prior notice, for:
- Breach of these Terms.
- Fraudulent or abusive behavior.
- Extended inactivity (12+ months for free accounts).
Upon termination:
- Your right to use the Services ceases immediately.
- Paid subscriptions will not be renewed.
- We may delete your account data after 30 days.
- Provisions that by nature should survive (IP, disclaimers, liability) remain in effect.
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in accordance with applicable rules, unless you opt out within 30 days of these Terms taking effect.
You agree to resolve disputes with us on an individual basis only and waive any right to participate in class action lawsuits or class-wide arbitration.
We reserve the right to modify these Terms at any time. For material changes:
- We will provide at least 30 days' notice via email or prominent notice on our website.
- Your continued use after changes take effect constitutes acceptance.
- If you do not agree with the changes, you may terminate your account.
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any provision does not constitute a waiver.
- Assignment: You may not assign your rights under these Terms without our consent.
- Force Majeure: We are not liable for delays caused by circumstances beyond our control.
